1. Parties & Event Details
This Agreement is entered into on , by and between JW Sounds ("Service Provider") and the Client listed below.
2. Services & Compensation
JW Sounds agrees to provide professional audio, sound, and visual lighting services for the specified event.
3. Payment Terms & Overtime
The remaining balance must be paid in full no later than 14 days prior to the event. If the Client requests performance time beyond the agreed end time, overtime will be billed at $100/hour, payable immediately prior to starting the extended performance.
4. Equipment, Power & Site Requirements
Client agrees to provide a clean, dry, level, and sheltered setup space (protected from direct sunlight, precipitation, and extreme heat/wind) with access to at least one dedicated 15-amp electrical circuit within 30 feet of the performance area. JW Sounds reserves the right to pause or terminate equipment operation if weather, water, or site conditions pose an operational hazard to safety or electronics.
If utility wall power is unavailable and a generator is required, it must be provided by the Client at their expense. The generator must be a pure sine wave inverter-type generator (e.g., Honda EU series or equivalent). Standard open-frame commercial generators are strictly prohibited due to severe voltage fluctuations that damage digital audio and lighting equipment. If an improper generator causes power interruptions or hardware failure, performance will pause until stable power is restored, with no refund or deduction for lost performance time.
5. Damage & Guest Conduct
Client accepts full financial responsibility for any physical loss, theft, or damage caused to JW Sounds’ audio, lighting, or support equipment resulting from the actions, conduct, or negligence of event guests or attendees.
6. Cancellation Policy
The retainer is strictly non-refundable.
If Client cancels within 90 days of the event date, the full remaining balance shall remain due and payable.
If Client cancels within 6 months of the event date, 25% of the remaining balance shall remain due and payable.
In the unlikely event JW Sounds cannot perform due to severe illness or emergency, JW Sounds will make reasonable efforts to secure a competent replacement or refund all payments received.
7. Agreement & Acceptance
